Concerned persons may submit their data, views, or arguments, either orally or in writing, at the hearing.  They may also be submitted to Tom Richmond FracComments@mt.gov, and must be received no later than 5:00 p.m. on June 23, 2011.

New Rule 3 recognizes that some formulas are trademarked and provides a provision to disclose only the product by trade name with the stipulation that the owner, operator, or service contractor must provide the specific information in the case of a spill or to a health professional who provides a written statement that knowledge of the chemical constituents of such product is needed for purposes of diagnosis or treatment of an individual and the individual being diagnosed or treated may have been exposed to the chemical concerned. The health professional may not use the information for purposes other than the health needs asserted in the statement of need, and may be required to execute a nondisclosure agreement.

New Rule 2 requires that the well owner or operator provide a list with a chemical breakdown of all solutions used with the recipe for the solution how much of each each chemical. Additionally, the recipes must be made public.

New Rule 1 requires that fracking and similar processes would only be allowed if they are expressly in the permit application for drilling.

The Oil and Gas Conservation Board and the DNRC said the new proposed rules are reasonably necessary in order to address safety issues associated with techniques used for oil and gas well completions. These techniques include hydraulic fracturing, which has become more prevalent throughout the United States in recent years.

New Rule 4 will give a burden of proof to fracking companies that mechanical integrity exists in a well. That will come in the form of testing under defined specifications.
